Workforce Housing Ordinance
Residents
in the 9th Representative District are concerned about the County's
new WORKFORCE HOUISING INCENTIVES LAW and the impact it will have
on our school district, roads and overall character of the Appoquinimink
area.
I firmly believe
that the County law, as written, is BAD PUBLIC POLICY and MUST
BE CHALLENGED. Many times, on the federal, state and local level,
laws are passed that have unintended consequences and have to
be repealed or modified. I believe that this is one of those times.
While the
County is making some attempt to readdress this issue, the results
of their attempt are not assured nor great enough. Their main
focus seems to be to try to place blame of the state. Title 9,
Chapter 26 of the Delaware Code clearly defines the responsibility
of the County Council - "to guide and control...development.
It is the intent...to encourage the most appropriate use of land,
water and resources consistent with the public interest and to
deal effectively with future problems that may result from the
use and development of land within their jurisdictions."
I concur with
the Southern New Castle County Alliance that the Chancery Court
is the only venue to readdress this law. Neither state legislative
action, nor the pending County Ordinance can address this issue
ex post facto, it can only stop the project submissions from occurring
from the enactment date forward.
I want to
thank those of you who brought this to my attention during the
summer, and to express remorse that neither the civic umbrella
groups nor the general assembly realized that this ordinance had
been introduced.
